Judge Fred Gibler handed down three consecutive life sentences to convicted
rapist Phillip Carle, and despite protests, he'll have to serve 25 before
he can be considered for parole.
As the sentence was announced, Carle told the judge to just wipe off the 25 years and leave him in prison; Gibler responded that he could certainly do that, but he didn't. Carle continually maintained his innocence, and alleges that his public defender, John Cossell, did an inadequate job. Gibler disagreed, saying Cossell did an outstanding job with what he had to work with, and denied a motion for a new trial.
One of his victims, however, told the court of the anguish she endured at the hands of Carle, and the lasting impact the attack has had on her. She asked that he be sentenced with no chance of ever being released.
He was convicted in
July of three counts of rape, which occurred at a Smelterville hotel. He had
earlier been convicted of rape and spent 13 years in prison, and was deemed
a violent sexual predator on his release.
